Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Crumbls, LLC ("Crumbls," "we," "us," or "our") governing your use of the Astrology web platform (the "Service").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.

1. The Service

The Service generates astrological charts, readings, compatibility comparisons, and electional ("best moment") searches based on birth and event data you provide. It is currently offered as a free beta. Features, availability, and pricing may change.

2. Entertainment purposes only

The Service is provided for entertainment, self-reflection, and personal interest only. Astrological readings, comparisons, electional windows, and any other output of the Service are not professional advice of any kind.

You agree that you will not rely on the Service for, and the Service is not a substitute for, professional advice regarding:

• Medical or health decisions
• Mental health or psychological matters
• Legal matters
• Financial or investment decisions
• Major life, relationship, or business decisions

Always seek the advice of a qualified professional for those matters. Any action you take based on the Service is at your own risk.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

4. Your account

You are responsible for:

• Providing accurate account information
• Keeping your login credentials secure
• All activity that occurs under your account

Notify us promptly if you suspect unauthorized use of your account. We are not liable for losses caused by unauthorized use of your account.

5. Beta status

The Service is in beta. This means:

• It may contain errors, bugs, or inaccuracies
• Features may be added, changed, or removed at any time
• The Service may be unavailable or interrupted
• Data may occasionally be lost despite our reasonable efforts

We provide the beta "as is" and make no guarantees about its reliability or continued availability.

6. Data about other people

The Service lets you enter birth information for other people and invite others to connect. By doing so, you represent that:

• You have the right to provide that information
• You will use it only for personal, non-commercial purposes within the Service
• You will not use the Service to harass, stalk, profile, or harm any person

If someone asks you to remove their information, you agree to do so. We may remove information or connections at our discretion if we receive a credible request or complaint.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access accounts, data, or systems that are not yours
• Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures
• Scrape, harvest, or collect data from the Service by automated means without our written permission
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law
• Interfere with or disrupt the Service or its infrastructure
• Resell, sublicense, or commercially exploit the Service without our written permission
• Upload malware or use the Service to transmit harmful code
• Use the Service to harass, abuse, or harm others

We may suspend or terminate accounts that violate these rules.

8. Intellectual property

The Service, including its software, design, text, and the structure of its readings and outputs, is owned by Crumbls and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes, subject to these Terms.

The astrological charts and readings generated for you are provided for your personal use. The underlying calculations rely in part on the Swiss Ephemeris library, which is subject to its own license.

You retain ownership of the birth and event data you provide. You grant us a license to use that data as needed to operate and provide the Service, as described in our Privacy Policy.

9. Subscriptions and payments

The Service is currently free. When paid subscription plans become available, the following will apply:

• Billing. Paid plans will be billed through Stripe, Inc. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
• Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then.
• Refunds. Except where required by law, payments are non-refundable. We may offer refunds at our discretion.
• Price changes. We may change subscription prices. We will give you reasonable advance notice, and changes will apply at your next renewal.
• Taxes. Prices may not include applicable taxes, which are your responsibility.

We will publish full subscription terms before charging any fees.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we discontinue the Service, or as otherwise permitted by law. On termination, the licenses granted to you end, and we will handle your data as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that astrological calculations or interpretations are correct or fit for any purpose. As stated above, the Service is for entertainment only.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CRUMBLS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Crumbls and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of the rights of any other person, including any misuse of another person's birth data.

14. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

16. Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Crumbls regarding the Service.
• Severability. If any provision is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
